“Our house is from the 2000s. Is a heater that has failed still the builder's problem?”
Arizona answers that with a date, and the date belongs to your house.
The statute gives eight years from substantial completion for a contract or implied-warranty action against the developer, with a narrow extension for trouble that first shows in the eighth year and a hard outer limit at nine. Which side of those figures a particular house sits on is determined by its own completion date, and that date comes from the documents. So it is the thing established first, and then the visit gets on with the heater.

Then there is a second clock, and it is the shorter of the two.
A complaint to the Registrar of Contractors about the contractor who did the original work has to arrive, in the statute's words, “within two years after the earlier of the close of escrow or actual occupancy.” What that changes on our side is practical: the old heater and its fittings are the evidence, so what happens to them is settled with you at the start of the job.

Rust through the seam means the vessel itself has gone.
A leak from the tank body ends the repair conversation. The heater is replaced, gas or electric, in the spot it stands in, and the installation carries 10% off. Where a single component has failed instead, that repair is offered first, and the parts fitted carry a one-year warranty.

On a gas tank that points at the burner side. On an electric one, it usually points at the lower element.
Both are repairs, and both are short work. What the visit adds is the tank's age off the rating plate, because the same component failure on a young tank and on an old one leads to two different recommendations.
The Date Arizona Counts From, and What Sits on Either Side of It
The sentence, and what it is counted from
Arizona Revised Statutes section 12-552 says that an action “based in contract may not be instituted or maintained against a person who develops or develops and sells real property ... more than eight years after substantial completion.” The clock does not start at the closing table, at the move-in date, or at the day the heater was set. It starts when the house was substantially complete.
Eight years, and then nine
The same section leaves one narrow door. Where the injury occurred, or a latent defect was discovered in the eighth year, an action may be brought “within one year after the date on which the injury ... occurred or a latent defect was discovered,” and then the statute closes it: no action “more than nine years after the substantial completion.” Nine is the end of the road, and the figure does not roll forward.
What the section reaches
It covers “any action based on implied warranty arising out of the contract or the construction, including implied warranties of habitability, fitness or workmanship,” which is the outer boundary the state puts around such a clause in a sales agreement.
The other clock, and it is shorter
Section 32-1162(A) governs when a complaint about the contractor who did the original work can reach the Registrar of Contractors. For new construction, it is “within two years after the earlier of the close of escrow or actual occupancy,” and for other projects, “within two years after the completion of the specific project.”
Why the year gets written down at an address in this village
In ZIP code 85086, which covers part of the village, fewer than one in twenty housing units date from 1989 or earlier, on the Census Bureau's Year Structure Built table. Almost nothing here is old enough for the question to answer itself. Which side of the statutes' dates a given house falls on is therefore a matter of its own completion date, which is a document to be found rather than a thing to be guessed at.

Tank Heaters Repaired, Replaced, or Neither
A tank fails one component at a time until it fails as a vessel, and everything before that point is its own repair. On gas: thermocouple or igniter, gas control valve, burner. On electric: element, thermostat, the reset behind the cover. On both: the anode, the flexible connector and the relief valve. Whatever is fitted during a repair is warranted twelve months.

The old heater leaves on the truck on the day, unless you have asked for it to stay. On a young house where the dates are still live, that gets settled at the quote.
