The City's sentence about water getting loose
Phoenix City Code section 23-33 is titled Escape of water prohibited, and it is short. It makes it unlawful “for any person to willfully or negligently permit or cause the escape or flow of water from any source in such quantity as to cause flooding, to impede vehicular or pedestrian traffic ... or to cause damage to the public streets or alleys of the City of Phoenix.” The section then adds its own arithmetic: “Each violation of this section, and each day on which a violation occurs, shall be considered a separate offense.” The test the section sets is what the water does once it is loose: whether it floods, whether it blocks a footway or a road, whether it damages a public street or alley. So what a drain-down has to settle is where forty or fifty gallons finishes up.
