Tempe's Four-Part Test for a Permit-Free Tank Swap

The wording in the city's code

The Tempe Administrative Code sets out which jobs are exempt from a building permit. For water heaters, the line reads: “Replacement of water heating appliances of the same type, fuel source and in the same location of equal or less amperage rating, and minor modification to electrical, plumbing, and mechanical connections to serve the appliance.” The same line limits it to houses, two-family homes and townhomes “where the appliance serves an individual dwelling unit.”

That gives four conditions, and a replacement has to pass all of them: the same type of heater, the same fuel, the same location, and an amperage rating no higher than the old one.

Reading the two rating plates

Every tank carries a rating plate. On an electric heater, it lists the voltage and the wattage of the elements, and dividing watts by volts gives the amperage, the figure that Tempe's fourth condition turns on. A customer who asks for faster recovery from bigger elements is asking for a higher amperage rating.

On a gas heater, the fuel and the location are usually easy to confirm. What can change is the type, for example a power-vent model that plugs into an outlet and vents through a fan, going in where an atmospheric tank stood.

Where the test gives no answer

The exemption does not spell out what counts as the same type. It does not say, for instance, whether a heat pump water heater counts as the same type as the electric tank it replaces. We do not guess at that. The city's own advice for anyone unsure whether a job needs a permit is to email permitcenter@tempe.gov, and that is where the question goes.

When a permit does apply

Tempe handles single-family permits through its online Citizen Access Portal, and the city says minor single-family projects may qualify for over-the-counter review. A gas pipe that has to be extended or rerouted to reach the new heater is permit work in its own right, regardless of the heater.

Same fuel, same spot: the simplest case.

A leak from the tank body means replacement. A gas tank of the same type in the same place, with no gas pipe changes, fits the exemption as written, and the job can move quickly.

“Can we get a 5,500-watt tank so the hot water lasts longer?”

A number on the new heater's label is what moves this job into the permit column.

A 5,500-watt set draws about 23 amps at 240 volts, compared to under 19 amps for 4,500 watts, so, on a plain reading of Tempe's wording, the replacement falls outside the exemption. The wiring also has to suit the new load, which is an electrician's work.

“We'd like the heater out of the hall closet and into the garage.”

A new location is its own condition.

Moving the heater fails the same-location test, and it usually brings new water, gas, or vent runs with it. It is planned as permit work from the start.

“Could a heat pump water heater replace our electric tank?”

Nobody at this company gets to answer this one, and neither does a catalog.
