The Arizona Rules Behind a Rental Repair

What the statutes say is set out below. It is no substitute for advice: your lease, your management agreement, and your own attorney decide how it lands on your property.

Where the law puts the plumbing

Under the Residential Landlord and Tenant Act, a landlord maintains the plumbing and other supplied facilities in good and safe working order, makes all repairs necessary to keep the premises fit and habitable, and supplies running water and a reasonable amount of hot water at all times. So a quote for a dead heater on a rental covers the unit and the connections it sits on, and the cosmetic items on the same sheet are priced separately for you to take or leave.

Why the go-ahead is the owner's to give

Where hot water or another essential service fails, the act gives the tenant remedies upon reasonable notice, and then, in its own words, says those rights do not include the right to repair. A tenant cannot hire the work done and hand you the bill for it. So the go-ahead comes from you or your manager, and a tenant who reaches us before that hears the same answer.

Entry, notice, and who sets the time

Arizona requires a landlord to give at least two days' notice of an intent to enter and to enter at reasonable times, except in an emergency. It also says a tenant who notifies the landlord of a maintenance request has given permission for entry for the sole purpose of acting on it, waiving that separate notice. So the window comes to us from you, and we work to whatever you send back.

In homes built before 1978, we only take on work that leaves painted surfaces undisturbed. If a repair would need a painted wall opened, that part goes to a lead-safe certified contractor you hire directly; we do not perform or arrange it. Once the contractor has opened the wall and comes back to close it, we do the plumbing inside. Plan that sequence before a tenant is given a date.
