That is the division Arizona's condominium act draws, and it is the division we quote to. Where a pipe lies partly inside and partly outside your unit, the part serving only you is allocated to you. Your declaration can move that line, which is why it outranks the statute in your building.

An approval packet is a spec sheet, a company name, and a date, and it takes less to assemble than it sounds.

Plenty of communities want a named contractor, a license number on file, and a working window agreed upon before anyone parks a truck. We work to an association's spec sheet and supply the company name and target date it asks for. Send the sheet, and we fill it in.

A heater standing inside a unit is normally that unit's equipment, and where your declaration agrees, this is your repair to approve and ours to make. We replace the heater and pipe it back up; the drywall and paint go to a finisher, because finishing is referred out.

What the closet swap actually looks like

Most of what a unit owner buys from us is one job: the water heater in the closet is out and replaced, and the building changes that day more than the heater does. The opening behind a louvered door is often narrower than the tank, so the route out, down the stairs or along the walkway, is looked at before a price is written, because on an upper floor it sets the time. A heater sitting over a neighbor's ceiling belongs in a pan with somewhere for the water to go, and where the existing pan has no drain line, or the line was capped off at some point, that is named in the quote rather than found on the day. On a unit with its own shutoff, the water is off in your unit alone while the tank drains, swaps, and refills; where the closet has no shutoff and the building has to be isolated, that belongs with the manager before a date is set. Either way, tell the neighbor below you which morning it is.

The lines we leave alone

Shared drain stacks and risers are outside our work in a six-unit building as much as a sixty-unit one, and an association that wants to hire us directly for work in a duplex or a garden apartment can do so on that same understanding: no stacks, no risers. Clearing a blocked line falls outside what we offer, and we do not work on mobile or manufactured homes at all.

A water heater in a closet in a building of three or more

Phoenix's permit exemption for replacing an existing water heater with a licensed contractor applies to one- and two-family dwellings. On its face, it does not stretch to a unit in a larger building, and the City does not spell that out either way.

So we raise it with you at the quote, and you check it with the City and the association before we set a date.

A fixture swap the community's rules reach anyway

The Phoenix code states explicitly that exemptions from its permit requirements do not authorize work performed in a manner that violates the code or any other law or ordinance.

Replacing a water closet, valve, or fixture like for like is exempt; relocating one is not. Either way it gets built to code, and the community's own rules still sit on top of that.

The Rules That Draw the Line for You

These are the statutes as they read. They are no substitute for advice, and your declaration, your community documents, and your own attorney settle what applies to your unit.

Where a unit ends

Where a fixture lies partly within and partly outside a unit's designated boundaries, the condominium act allocates the portion serving only that unit to that unit and leaves any portion serving more than one unit in the common elements. It is prefaced by the words except as provided by the declaration. We quote the first half of that sentence and decline the second.

Who repairs what, by default

Unless the declaration provides otherwise, the association maintains, repairs, and replaces the common elements, and each unit owner does the same for the unit. That default is why a quote for your unit goes to you, a quote for anything shared goes to the board, and the shared items go back to the board with no number attached.

In a townhome or a non-condominium HOA, there is no statutory split to fall back on at all, because the Planned Communities Act holds no counterpart to those two sections, so the association's own spec sheet is what we build to.

Which document you read first

The declaration, then the rules, then whatever spec sheet the association hands contractors. In a condominium, the act fills gaps the declaration leaves open. In a planned community there is no statutory gap-filler, so a silent declaration is a question for the board or counsel before it reaches a plumber.

Who authorizes the work

A line or fixture serving your unit alone is yours to approve and pay for. When the unit is rented out, the owner approves the job, and our landlord and property management page outlines that workflow.

What a building of three or more changes

It changes which permit counter the work goes through, and it puts a question mark over the water-heater exemption written for one- and two-family dwellings. Ask both the City and the association before a date goes on the calendar.

What a duplex changes

A duplex falls outside Phoenix's commercial multi-family permit list, and unless it was created as a condominium, the act's boundary section does not govern it. We perform duplex work on your side of the building, leaving the shared lines where they are.

A permit belongs to whoever on your project is taking one out, and we build the visit around the date it is obtained.
